TERMS & CONDITIONS

Fit Test Australia

Effective 30 July 2026

These Terms and Conditions (“Terms”) govern your use of the services and website provided by Fit Test Australia Pty Ltd (ABN 70 658 559 721) (“FTA”, “we”, “us” or “our”), including bookings made through www.fta.net.au, in-clinic and mobile testing services, training services, and the purchase of products through our shop. By booking a service, purchasing a product, or using our website, you agree to be bound by these Terms.

1. About FTA

FTA provides quantitative respirator fit testing (QNFT), audiometry testing, spirometry testing, ear fit testing, RESP-FIT accredited training, silica awareness training, and the supply of respiratory protective equipment (RPE), hearing protection equipment and related consumables. As a national service provider, we operate clinics in New South Wales, Victoria, Queensland, Western Australia and South Australia, and provide mobile services to sites in every state and territory of Australia.

2. Bookings

  • Bookings can be made online at www.fta.net.au/book-online, by phone, or by email, and are confirmed once accepted by FTA.

  • Where a business or PCBU books testing on behalf of workers, that business is responsible for ensuring the individuals attending are aware of, and agree to, these Terms.

  • FTA reserves the right to decline or reschedule a booking, including where pre-test eligibility requirements (see section 3) are not met, or where operational circumstances require it.

3. Cancellations, Rescheduling and No-Shows

We ask that you provide as much notice as possible if you need to cancel or reschedule a booking. Cancellations or reschedules made with less than [24] hours' notice, and/or non-attendance without notice, will incur the loss of the full fee. Fees for missed appointments will be charged to the individual or the booking business, as applicable.

4. Pre-Test Requirements and Eligibility

To be fit tested, you must:

  • Be clean shaven where facial hair would interfere with the seal of a tight-fitting respirator (no beard, goatee, or several days' stubble in the seal area).

  • Not smoke, vape, or consume food within 30 minutes prior to testing, as this can affect particle count readings and compromise the test.

  • Bring personal mask where applicable or use respiratory protective equipment (RPE) that in line with wat your workplace provides.

If these requirements are not met, your test may be delayed, declined, or may result in an instant fail (denied test due to facial hair), in accordance with AS/NZS 1715:2009. FTA is not responsible for any delay, inconvenience or additional cost arising from a client's failure to meet pre-test requirements.

5. Fees and Payment

Current pricing for our services is available on our website and is subject to change without notice. Prices listed do not include any additional masks tested during a single test session, which are provided at no extra charge. Payment is due at the time of booking or at the time of service, unless alternative payment terms have been agreed in writing (for example, for corporate or PCBU accounts).

6. Products and Shop Purchases

Where you purchase respiratory protective equipment, hearing protection equipment, PortaCount units or consumables through FTA, the following applies:

  • Product descriptions, pricing and availability are as displayed on our website or as otherwise quoted, and may change without notice.

  • Fit Test Australia ships products Australia-wide.

  • Orders are generally processed within 1–2 business days following receipt of payment.

  • Delivery timeframes vary depending on the destination and shipping method selected at checkout. Standard delivery is generally 2–10 business days within Australia; however, regional and remote locations may require additional time.

  • Shipping costs are calculated at checkout based on the delivery location, parcel size and weight.

  • Once your order has been dispatched, you will receive tracking information (where available).

  • While every effort is made to meet estimated delivery timeframes, Fit Test Australia is not responsible for delays caused by third-party courier services, weather events or circumstances beyond our reasonable control.

Order Accuracy

  • Customers are responsible for ensuring that all order details, including delivery address, product selection, quantities and sizes, are correct at the time of purchase.

  • If you identify an error with your order, please contact Fit Test Australia as soon as possible. We will make every effort to amend the order prior to dispatch; however, changes cannot be guaranteed once an order has been processed or shipped.

Returns & Exchanges

Faulty, Damaged or Incorrect Products

  • If you receive a product that is faulty, damaged or differs from what you ordered, please notify Fit Test Australia within 7 days of delivery.

  • Where required under the Australian Consumer Law, Fit Test Australia will provide an appropriate remedy, which may include:

  • replacement of the product;

  • repair (where applicable);

  • refund; or

  • exchange.

  • Photographs of the product and packaging may be requested to assist with assessing the claim.

Change of Mind

  • Due to the nature of respiratory protection products and hygiene considerations, Fit Test Australia does not accept returns or exchanges for change of mind, incorrect selection, or incorrect sizing where:

  • the product has been opened;

  • the original packaging has been damaged;

  • the product has been worn, fitted, tested or used; or

  • the product cannot be resold as new.

  • Unopened products in their original, sealed packaging may be considered for return at Fit Test Australia's discretion within 14 days of purchase.

  • Approved change-of-mind returns may be subject to:

  • return freight being paid by the customer;

  • inspection upon receipt; and

  • a restocking fee of up to 10% where applicable.

  • Shipping charges are non-refundable unless required under Australian Consumer Law.

Australian Consumer Law

  • Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available to consumers under the Australian Consumer Law.

  • Customers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Customers are also entitled to have products repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

  • Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law (ACL) that cannot lawfully be excluded, restricted or modified.

7. Fit Test Results and Certification

A quantitative fit test conducted by FTA assesses the seal of a specific respirator, make, model and size against your face at the time of testing, using the equipment and standards specified in AS/NZS 1715:2009. A pass result confirms an adequate seal was achieved at the time of testing under test conditions; it does not guarantee ongoing protection if the respirator is not donned correctly, is damaged, is substituted for a different make/model/size, or if your facial characteristics change (including changes in facial hair, weight, or dental work), equipment is not cleaned, stored or maintained in line with manufacturer recommendations.

Fit testing is one component of a respiratory protection program. Responsibility for selecting appropriate RPE, ensuring correct use and maintenance, and complying with AS/NZS 1715:2009 and applicable WHS laws rests with the individual wearer and their employer or PCBU, not with FTA.

8. No Medical Advice

Audiometry and spirometry testing provided by FTA are screening measurements and do not constitute a medical diagnosis. Results are provided for workplace health and safety compliance purposes. If a test result indicates a possible health concern, we recommend you consult a general practitioner or appropriate medical professional. FTA does not provide medical advice, diagnosis or treatment.

9. Limitation of Liability

To the maximum extent permitted by law, FTA's liability for any loss or damage arising from or in connection with our services or products is limited to, at FTA's option, the resupply of the relevant service or product, or the cost of resupplying that service or product. This limitation does not apply to any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by FTA's negligence, or any non-excludable consumer guarantee under the Australian Consumer Law.

FTA is not liable for any indirect, consequential or special loss, including loss of profits, loss of business, or loss arising from a third party's reliance on a fit test result outside the scope described in section 7.

10. Your Responsibilities

If you are a business or PCBU booking testing or training on behalf of workers, you are responsible for:

  • Ensuring workers attending are informed of and comply with pre-test requirements.

  • Providing FTA with accurate information necessary to deliver the service.

  • Your own compliance with WHS laws and AS/NZS 1715:2009, including the selection, provision, use and maintenance of RPE beyond the scope of the fit test itself.

11. Applicable Work Health and Safety Laws

FTA delivers services in support of work health and safety compliance in the state or territory where the service is performed. Most Australian states and territories have adopted harmonised model Work Health and Safety (WHS) laws. Victoria has not adopted the model WHS laws and instead regulates work health and safety under the Occupational Health and Safety Act 2004 (Vic) and associated regulations. Where FTA provides services in Victoria, references in these Terms to “WHS laws” should be read as referring to the equivalent Victorian OHS legislation.

Regardless of which state or territory law applies, the technical standard FTA applies to fit testing — AS/NZS 1715:2009 Selection, use and maintenance of respiratory protective equipment — is a national Australian/New Zealand Standard and applies consistently across all locations in which we operate. It remains the responsibility of the client, worker, employer or PCBU to confirm which specific WHS or OHS legislation applies to their workplace and to ensure their own compliance with it; FTA's role is limited to delivering the testing, training and reporting services described in these Terms.

12. Intellectual Property

All content on our website and in our training and reporting materials, including text, graphics, logos and reports, is owned by or licensed to FTA and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or modify this content without our prior written consent, other than using your own fit test report or certificate for its intended compliance purpose.

13. Website Use

You agree to use our website and online booking system lawfully and not in a way that could damage, disable or impair the website, or interfere with any other party's use of it. We do not guarantee that our website will be uninterrupted, error-free or secure at all times.

14. Privacy

Our collection and handling of your personal information, including health information, is governed by our Privacy Policy, available at www.fta.net.au, which forms part of these Terms.

15. Consumer Guarantees

Our services and products come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to cancel a service contract or reject faulty goods and receive a refund, or to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services re-supplied, or goods repaired or replaced, if they fail to be of acceptable quality and the failure does not amount to a major failure.

16. Termination

FTA reserves the right to refuse service, cancel a booking, or discontinue supply of a product to any person, at our discretion, including where a client's conduct is unsafe, abusive, or otherwise inappropriate.

17. Governing Law

These Terms are governed by the laws of New South Wales, Australia — the state in which FTA is registered and headquartered — and each party submits to the non-exclusive jurisdiction of the courts of New South Wales, regardless of the state or territory in which a particular service was provided.

This does not limit the application of Commonwealth legislation, which applies uniformly to FTA's operations across every Australian state and territory in which we provide services — including the Australian Consumer Law (contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and the Privacy Act 1988 (Cth). Nor does it exclude any mandatory state or territory law (including WHS or OHS legislation referred to in section 11) that applies to services performed in that state or territory and cannot lawfully be excluded or displaced by agreement.

18. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website. These Terms were last updated on 30 July 2026.

This document has been prepared as a general-purpose set of terms and conditions based on FTA's publicly available services, pricing and business practices. Sections marked in square brackets require FTA to confirm specific operational details (such as cancellation notice periods, fees, and returns policy) before publishing. This draft has not been reviewed by a qualified Australian lawyer — given this is a health-services business with real liability exposure, we strongly recommend legal review before these Terms are published or relied upon.
